Cracker Barrel Attack-ATL




Clayton County prosecutors said Wednesday they are trying to have felony charges reinstated against a man who attacked an Army reservist in front of her child outside a Morrow Cracker Barrel.

A judge dropped a felony child cruelty charge against Troy D. West, Jr. He was released from the Clayton County jail Friday -- two days after being arrested for striking Tashawnea Hill in front of her 7-year-old daughter.

District Attorney Tracy Graham Lawson said she may file felony charges against West. "We're reviewing the police reports and talking to witnesses to determine whether felony charges should be presented to the grand jury," Lawson said Wednesday.

West, 47, is charged with battery, disorderly conduct and cruelty to children -- all misdemeanors. He is also the subject of an FBI investigation for committing a possible a hate crime. Police said West, who is white, yelled racial slurs at Tashawnea Hill as he was kicking and punching her in the head.

The attack occurred as Hill and her daughter were leaving the Morrow restaurant and West was heading inside, Morrow Police Capt. James Callaway said. Hill told West to be careful after the restaurant door came close to striking her child, Callaway said. That's when West became enraged and attacked the woman, police said.

“She kept saying, ‘Sir, I’m a United States soldier, don’t do this,’ ” Callaway said. On Wednesday, the Atlanta office of the FBI said they have launched a "preliminary" investigation for a possible hate crime, at the request of Morrow Police.

West told Morrow police he became upset because Hill spit on him after accusing him of trying to hit her daughter, according to the police report. But several witnesses said they never saw Hill spit on West.

West remains free on a $12,500 bond. He is scheduled to return to court on Sept. 28. West runs Troy's Paint & Body & Auto Salvage in Poulan, which is in south Georgia near Albany.
